The application (Ref. No. NP5/62/LU372) for a Certificate of Lawful Use was submitted by the Welsh Government on the 24th December 2010.
This is not a planning application, but an application to determine lawful use of the site. In this respect, the application is simply a matter of considering legal evidence i.e. a Certificate of Lawful Use is not something to consider within the context of planning policy, but a legal mater which either succeeds or fails on the basis of the evidence presented.
Up to this point, the Authority has not received nor considered any planning applications by the applicant.
Because of the history of the site and the nature of the application, the advice of a Barrister was sought. Legal advice was given. Following the consideration of all the relevant documents, including the legal opinion, and a visit to the site, a Certificate of Lawful Use was given on the 29th July 2011 for the following use:
“Use of the site (edged red on the appended plan) for Research and Development for the testing, evaluation and development of unmanned aerial vehicles (UAVs)”
It is an application for a Certificate of Lawful Use that has been determined. This is not a sign of the Authority’s stance for or against the appropriateness of any kind of development on the site at Llanbedr in the future.
